The NJ Department of Environmental Protection’s (NJDEP) Bureau of Release Prevention recently updated the List of Hazardous Substances in N.J.A.C. 7:1E Appendix A for the Discharge Prevention, Containment and Countermeasure (DPCC) program.
Per this update, Appendix A now includes the acidic and anionic forms of perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), the anionic form of perfluorononanoic acid (PFNA) and the salts and esters for all three chemical groups. An illustrative list of compounds identified as salts and esters of PFNA, PFOA, and PFOS can be found here. The updated list for Appendix A can be found here.
New Guidance Documents for DPCC -
In addition to the change outlined above, the NJDEP also released a series of updates to their various DPCC program guidance documents.
The following documents have seen updates in calendar year 2020:
- A Guide to the Preparation of DPCC & DCR Plans: A complete guide to each required section of the DPCC and DCR plans. This document also includes a very helpful checklist for what must be included in both the DPCC and DCR plans (valuable for both plan creation and renewals)
- Plan Renewal Guidance: A single page document that provides detail on what must be submitted with each renewal.
- Annual Audit Checklist: This document is the same one that NJDEP program auditors use when completing their site inspections.
